The Website is operated by Francis Ong, doing business as Why Does This Website Feel Off? These Terms of Use cover the Website itself, its free content, and the free checklist. Our paid written website review is additionally governed by our Review Service Terms, and any downloadable guide or other digital product is governed by our Digital Product Terms, License, and Refund Policy.

3. Permitted Use

You may use the Website to read its content, download the free checklist, and request a paid written review for your own business or client work. You may not use the Website in a way that violates any law, attempts to disrupt or gain unauthorized access to it, or infringes anyone else’s rights.

4. Ownership of Content

The specific text, worksheets, checklists, examples, visual design, and other original expression on the Website — including our written explanation of the OFF Review approach, the fictional ClearPath Home Services materials, and any paid guide — is owned by Francis Ong or used under license, and is protected by copyright and other applicable law. Our branding, including the Why Does This Website Feel Off? name and the OFF Review name, is also protected under applicable trademark and unfair competition law to the extent it functions as a brand identifier.

We do not claim ownership of the general idea of organizing a website review around clarity, focus, and finish, or of any similar review method, process, or approach. Copyright protects our particular written expression of it, not the underlying idea, system, or procedure. Someone else remains free to describe or use a similar approach in their own original words.

You may not copy, resell, scrape, republish, redistribute, or otherwise commercially exploit our original written content, worksheets, examples, or branding without our prior written permission. This includes the free checklist: it is free to read and use for your own decisions, not free to republish or resell as your own material.

The Website provides general, educational information about website design and review. It is not a substitute for professional advice. Nothing on the Website constitutes legal, accessibility, security, financial, or technical advice, and we are not a law firm, accessibility auditor, security firm, financial advisor, or development agency.

6. No Guaranteed Results

We do not guarantee that using our free checklist, reading our content, or purchasing a written review will produce any particular website outcome or business result. Website performance depends on many factors outside our control.

7. Third-Party Links and Services

The Website may link to or rely on third-party services. Review purchases are processed by Stripe, a third-party payment provider with its own terms and privacy practices. Review intake is handled directly by email, not through a third-party form. The current Website has no connected email-signup or analytics provider. If those features are activated, the relevant providers will have their own terms and privacy practices. We do not control third-party services and are not responsible for their content, availability, or practices.

8. Service and Content Availability

The current Website is a static HTML build. Review purchasing is processed through Stripe. The free checklist is a direct PDF download that does not require an email address. Review intake happens by direct email after purchase, not through a form. Analytics is not currently connected. We try to keep the Website available and functioning, but we do not guarantee uninterrupted access. The Website, or any of its features or content, may change, be limited, or be discontinued at any time.

9. Limitation of Liability

To the fullest extent permitted by law, Francis Ong is not liable for any indirect, incidental, or consequential damages arising from your use of the Website or its content, including any decision you make about your own website based on that content. Our total liability for any claim arising from the Website is limited to the amount, if any, you paid us in the twelve months before the claim arose.

10. Indemnification

If your use of the Website violates these terms or applicable law and that violation directly causes a claim against us, you agree to reimburse us for reasonable costs resulting from it.

11. Governing Law

These terms are governed by the laws of the State of Kansas, without regard to conflict-of-law principles.

We may update these Terms of Use as the Website or business changes. The version posted at wdtwfo.netlify.app/terms is the current one and applies going forward from its effective date.
